Pre- and Post Trip Inspections
Under 49CFR 396.11-.13, every motor carrier company must require its drivers to complete pre- and post-trip inspections. All drivers are required by law to conduct visual inspections to ensure the motor vehicle they are driving is safe to operate and maintain a copy of the inspection reports in the vehicle at all times. Failure to complete the inspection and maintain the report is a violation of the law.
Safety and Compliance
Vehicle Inspection Reports (VIRs) identify the vehicle and list any defects or deficiencies that could affect the safety of the vehicle or result in its mechanical breakdown. Even if no defect or deficiency is identified, the VIR must be completed and in the vehicle at all times. Drivers are required to sign the VIR upon completion of the inspection. All repairs that could affect the safe operation of the vehicle must be repaired and signed-off by the repairing mechanic and accepting driver. Failure to comply with this rule including the ability to demonstrate compliance is a violation of the law.

Vehicles, Drivers & Operations, It all Matters
Compliance Safety Accountability 2010 (CSA 2010) is a Federal Motor Carrier Safety Administration (FMCSA) initiative to improve large truck and bus safety with the goal of reducing commercial motor vehicle (CMV)-related crashes, injuries and fatalities. The Safety Measurement System (SMS), CSA 2010's operational model, quantifies the on-road safety performance of carriers and drivers into a score that will be used to identify carriers for interventions in the form of warning letters, inspections and follow-on audits. If this intervention process fails to improve an unfit carrier's SMS scores, the FMCSA will intervene and potentially force the carrier to discontinue operations.
Focus on the BASICs
CSA 2010's SMS quantifies the on-road safety performance of carriers in terms of seven Behavior Analysis Safety Improvement Categories (BASICs) for a period of 36 months: Unsafe Driving, Fatigued Driving, Driver Fitness, Controlled Substances/Alcohol, Vehicle Maintenance, Cargo-Related, and Crash Indicator. The SMS uses a motor carrier's data from roadside inspections, including all safety-based violations, State-reported crashes, and the federal motor carrier census data to quantify performance and to monitor whether safety issues are improving or getting worse.
